The Bulgarian legislation provides rules that a foreigner can enter the territory of Bulgaria when having proper document for overseas travel (i.e a passport) or substituting document, and a visa /transit or other/ as well, when the last is required. The airport transit visa “A” is issued by the consular section at the Bulgarian embassies abroad one hand, and by the border control here on another, in situations where the applicant wishes to travel and should enter the international transit areas at the Bulgarian airports between flights, leaving Bulgaria with the first next flight towards their final destination. Such type of traveler – holder of a transit visa – is considered as “not entered the territory of Bulgaria”.
The transit visa for airport transit type “A” is issued towards foreign citizens, who hold, together with their passport, a valid travel document or similar document, issued by several countries, which names have been precisely detailed in Attachment N1 to the Ordinance for the order and requirements for the issuance of visas. These countries are: Afghanistan, Bangladesh, Ghana, Ethiopia, Eritrea, Iraq, Iran, Democratic Republic of Congo, Nigeria, Pakistan, Somalia and Sri Lanka. The above detailed legal requirement provides that citizens of these particular countries are legally allowed to pass transit through the Bulgarian airports for changing flights, when travelling to other destinations, only if they hold visa type “A”.
The local Bulgarian legislation describes precisely a concrete list of documents that should be presented by the applicant, when applying for airport visa type“A”, depending of their concrete situation and status. Therefore the particular needed documents obviously vary for every individual case.
We can provide legal consultation towards foreign applicants in advance on the necessary requirements before applying for visa and also for the exceptions in the legislation that may not allow issuing visa. We can also help applicants via instructions for preparing and filling their visa application and resp. with legal advice about the documents needed to support their application. In our capacity of legal practitioners, we can appeal on behalf of the applicant, eventual refusal for issuing visa, at the local Bulgarian court of law, which body is legally entitled to hear and decide on this specific type of appeals of administrative refusals.
